Abstract
Pursuant to Article 4421 § 2 of the Civil Code, a claim for compensation for damage caused by an offence (a crime or misdeed) is subject to a limitation period of twenty years from the date of commission of the offence. As the Supreme Court explained in its resolutions of 25 May 2018, III CZP 108/17 and III CZP 116/17, this rule also applies in a situation when criminal proceedings were discontinued due to the fact that the perpetrator could not recognize the significance of his or her actions or control their conduct.
