Abstract
The form of judicial supervision, quite laconically and vaguely regulated in Art. 972 of the Code of Civil Procedure, forces one to seek a ratio for its introduction into the system of law. A closer analysis of Art. 972 of the Code leads to a conclusion that supervision of an official authority of an auction carried out in the course of enforcement against real estate is not only repressive (by removing the irregularities perceives), but also preventive (by issuing orders aimed at ensuring proper performance of the bailiff). This supervision is connected with responsibility of the state for the legitimacy of an auction of real estate conducted by the bailiff and the importance of real estate in the system of justice.
