Abstract

The article analyses the right to waive an appeal against the administrative decision, entered to the Code of Administrative Procedure under the amendment of April 2017. In particular, the author made an attempt to establish what are the premises for waving an appeal, what are the effects of not observing them or whether the waiver declaration could be revoked and on what conditions. The key aspect is how waiver of an appeal affect th environmental organizations’ rights, in particular in connection with the appeal procedure as defined by Directive 2011/92/EU of the European Parliament and Council.
