Abstract

The article presents the views of the doctrine and the judicature indicating that the proceedings for the division of inheritance need to be (obligatorily) suspended if a party thereto dies in the meantime. In the author's opinion, suspension of the proceedings for the division of inheritance due to the death of participant party should always be optional, subject to a review by the court in each case. Therefore, in the conclusion de lege ferenda postulates have been presented, which allow to reduce significantly the duration of the proceedings for the division of inheritance in the above-mentioned situation.
