Abstract

A court order to annul a bailiff’s decision concerning the amount of the enforcement fee and referring the case for re-examination is unappealable. The court assigns enforcement to a bailiff in a correct manner, whereas the decision issued pursuant to Art. 767 et seq. of the Code of Civil Procedure donot provide for the substantive basis of appeal at all. It exclusively ends the proceedings before the court which performs judicial supervision over the bailiff as the enforcement authority, but does not end the proceedings with respect to the costs of enforcement.
