Abstract
The aim of the article is to analyze, in a rather detailed manner, the premises for meeting the documentary form newly introduced to the Polish Civil Code and, in the context of follow-up legal acts, the consequences of a failure to do so. One of the premises for meeting the documentary form is that a declaration of intent shall be made in the form of a document, and thus the article extensively refers also to the definition of a document laid down in Art. 773 of the Civil Code and submits it to critical analysis.
