Abstract
The institutional lease is a new type of the residential premises lease which has been introduced to Polish law as of 11 September 2017. The provisions on the institutional lease have been laid down in the act of 21 June 2001 r. on the protection of tenants’ right, municipal housing resources and amendments to the Civil Code (Art. 19f–19j). Although the new provisions are similar to the statutory regulation of the occasional lease (see Art. 19a–19e of the said Act) there are some material differences between these two types of lease. The article discusses these differences and evaluates the new provisions. The author criticizes the lack of protection for the tenants under the provisions on the institutional lease, especially the tenants of the residential premises included in the National Real Property Resources.
