Abstract
The article discusses the issue of controlling the contractor and the subcontractor by the contracting authority and the National Labour Inspectorate at the stage of a public contract performance with respect to compliance with the provisions of social and labour law. The relevant regulations were introduced in EU law and then implemented into Polish law. The article analyses the correctness of implementation and possibility to control fulfilment of these obligations effectively. A detailed analysis of this issue allowed to evaluate the adopted solutions and to formulate de lege ferenda conclusions.
