The effect of the declaration of bankruptcy on arbitration proceedings in the light of the Restructuring Act

Abstract

The principal aim of the article is to analyze the effect of the declaration of bankruptcy on arbitration proceedings, in the light of the new regulations introduced by the Restructuring Act of 15 May 2015 amending the Bankruptcy and Reorganization Act and the Code of Civil Procedure. The provisions of Bankruptcy and Reorganization Act in force until 1 January 2016 (in particular its Art. 142 and Art. 147) and the Code of Civil Procedure (Art. 180 ) have been compared with the legislative practice of other European countries from the viewpoint of Poland’s international commitments. The analysis allows to assess the current and previous regulations and to indicate possible legal and practical consequences of the January amendments.
