Creditors’ rights and risks in restructuring proceedings

Abstract

The text describes the solutions stipulated in the Restructuring Act of 15 May 2015 (Journal of Laws of 2015, item 978), which are important from the viewpoint of the creditor participating in one of the procedures provided for in the Act. In the first place, the article describes general benefits arising for creditors from the analyzed act, and then the specific rights of creditors divided into the following groups: personal decisions, decisions affecting the course of the proceedings, and organizational issues. Next, the author draws attention to the potential risks for creditors inherent in the new regulations. The conclusion highlights the most important issues of the earlier arguments.
