Abstract

In this article the author discusses the issue of effectiveness of the right of the defendant to a defense counsel in the light of recent amendments to the Code of Criminal Procedure (CCP). In this context, particular attention is paid to the institution of the defense counsel on request regulated in repealed Art. 80a of the CCP and thus observable (in connection with the entry into force of the Act of 11 March 2016 amending the Code of Criminal Procedure and certain other acts) restriction of access to legal aid, in consequence formally lowering the standard of the right of defense.
