Abstract

Notwithstanding the amendments, the crime of managerial corruption, regulated in Art. 296a of the Penal Code, continues to be obscure as regards its substance and the construction of its objective characteristics is very complex. The article tackles the objective scope of this offence, in particular the construction of its characteristics “in exchange for the abuse of powers vested in them or failing to fulfil their duties”.
