The obligating decision in cases for declaring a contractual clause as prohibited in the banking sector

Abstract

The amended Competition and Consumer Protection Act entered into force on 17 April 2016. One of the amendments is the replacement of judicial verification of standard contractual clauses with in abstracto administrative verification. The President of the Competition and Consumer Protection Office is in charge of issuing commitment decisions which allow imposing a fine. This solution may be particularly relevant to the banking sector.
