Abstract

The article deals with the requirements concerning the business name of a limited partnership and a partnership limited by shares. In particular, the article discusses issues arising from the legal requirement to include the name of a legal person being an unlimited partner into the partnership’s business name, as well as those concerning liability of limited partners or shareholders for having their name in the partnership’s business name. The author believes that the requirement to have the name of an unlimited partner included in the business name of a limited partnership or partnership limited by shares should be abolished.
