Abstract

This article is aimed at describing the procedural position of a consumer vis-a-vis a seller in connection with asserting claims due to the defect of the item purchased. The publication describes the court proceedings going on in the years 2010-2012: the facts (including the description of prejudicial actions of the parties) and the legal status of the case, the course of the proceedings with special consideration of evidentiary proceedings, as well as the verdicts passed. Apart from that, the article outlines and briefly comments the changes introduced by the Act of 30 May 2014 on consumer rights.
