Abstract

The order to return of an expenditure accounting request submitted under the proceedings for the division of inheritance and annulment of co-ownership is appealable by way of a complaint. The initiation of the relevant proceedings is based on a party’s request and its structure is not substantially different from that of a trial, whereas the legislator allows for the consideration of the entirety of relationships between co-owners and claims arising in respect thereof.
