Power of attorney to give consent for the provision of a medical service

Abstract
The articles discusses the issue of admissibility of appointing an attorney who would submit a declaration of consent or refusal thereof for the provision of a medical service on behalf of the entitled person (patient, patient’s legal representative). Such subject was inspired by the Supreme Court Resolution of 13 May 2015, III CZP 19/15 (unpublished). A view was expressed therein that “A legal representative of a minor may grant a power of attorney to submit a declaration of consent provided for in Art. 34.3 of the Medical Professions Act of 5.12.1996 (consolidated text: Dz.U. of 2015 item 464)”.
