Abstrakt
Celem niniejszego artykułu jest analiza treści art. 218a KK. Przepis ten ustanawia sankcję za naruszenie zakazu handlu w niedzielę i święta. Zawiera on liczne zwroty budzące rozbieżności interpretacyjne. W opracowaniu autor stara się zdekodować znamiona typu czynu zabronionego oraz przewidzianą reakcję w postaci kary kryminalnej, a także przedstawia postulaty de lege ferenda.
Criminal liability for the infringement of trade ban on Sundays and holidays in the light of article 218a of the Polish Penal Code
The aim of this study is to analyze article 218a of the Polish Penal Code. This provision establishes penalty for the infringement of the trade ban on Sundays and holidays, which has been recently introduced into Polish law to protect commerce employees’ right to leisure. The interpretation of this penal provision raises several doubts. The article attempts to interpret constituent elements of crime and penalty provided for its infringement. The author proposes remarks regarding potential amendment to this provision.Keywords: trade ban on Sunday, Polish Penal Code, work performance.
