Abstrakt

The aim of the article is to analyse the topic of labour protection in the context of Transatlantic Trade and Investment Partnership. The author makes an attempt to compare labour standards in the EU and the US as well as ponders the topic of collective bargaining and the concept of subordination outside competition law on the basis of judgments. Another issue covered in the article concerns the distinction between workers and employees under US law and also the three-element common law test.
