Abstract

Intergenerational succession planned in a proper way, with the help of a family foundation, may constitute an alternative to current solutions, which fail to tackle the issue of protection of business against fragmentation of assets or their disposal by the successors. The potential tax appeal of such a solution will depend on appropriate implementation preceded by a due analysis of tax and legal consequences, associated with its implementation. Moreover, a family foundation is also definitively more accessible, as opposed to, e.g. closed-end investment funds or alternative investment companies. One should hope that the lawmaker, while deciding on the introduced model of taxation of family foundations, in the future, will only refine accepted solutions in order to eliminate already existing doubts of interpretative nature, and will not significantly change the model of taxation.
