Abstract

The article analyzes the change made to the Code of Civil Procedure by the amendment of 9 March 2023 regarding the mandatory statement of posting of a pleading as referred to in Article 132 §1 of the Code of Civil Procedure. The amendment, which took effect on 1 July 2023, requires professional attorneys to include in their pleadings a statement that the pleading was posted „via the operator referred to in Article 165 §2 of the Code of Civil Procedure” instead of the earlier „about its posting by registered letter.” The article analyzes whether, in view of the amendment, it becomes necessary to change the practice of professional attorneys within the applied formula of the statement referred to in Article 132 §1 of the Code of Civil Procedure. A comprehensive interpretation of the provision in question in its new wording dictates that it should be assumed that the hitherto commonly used formula of the statement „about posting a pleading to the other party by registered letter” still fulfills the formal requirement established by it.
