Abstract
The article analyzes the issue of admissibility to apply art. 115 of the Civil Code to the course of limitation periods in the context of two divergent judgements of the Supreme Court: the resolution of 22 May 2024 (III CZP 21/23) that excluded such a possibility referencing directives of the linguistic interpretation and the verdict of 14 February 2025 (II CSKP 1946/22) which allowed the application of art. 115 of the Civil Code, based on its teleological interpretation. In the conclusion of the analysis, the author postulates an unequivocal legal settlement regarding the application of art. 115 of the Civil Code to the course of limitation.
