Abstract

The possibility of submitting affidavits was introduced by the Act of 6 July 2019 amending the Code of Civil Procedure and certain other acts under Art. 2711 of the Code of Civil Procedure. The amendment has many advantages that may be used by all participants to judicial proceedings. However, due to the the fact that the regulation is incomplete practical application the new provision arouses a lot of doubts, which in turn makes it necessary to seek new solutions so far not used in judicial proceedings. It also faces judges and professional attorneys with a challenge to ensure that evidence is properly taken witness affidavits and is thoroughly verified.
