Abstract
When pursuing claims for compensation, the injured party should analyse the case in detail in order to determine the entity responsible for the loss, because sometimes claims are settled by another entity, e.g. under the Direct Claims Adjustment system. This means that another entity settles the claim, while another one is liable.Incorrect designation results in negative procedural consequences, i.e. dismissal of the claim, charging the claimant with costs, or even prescription of claims against the relevant entity. Therefore, referring to de lege ferenda suggestions, it is important to specify in detail the rights of injured parties as regards the possibility of filing a lawsuit in order to avoid misidentification of parties in the claim. This is a postulate aimed at protecting the interests of injured parties, who are a weaker party in the process of claiming damages and should be properly instructed.
