When YouTube suspends your sports channel. A roadmap for youtubers

Abstract

YouTube has seen a significant number of unjustified reports alleging that a user of this platform has been violating its rules or even infringing the rights of others. Although baseless, these reports often lead to blocking users' YouTube channels. In such case, a claim for damages under the ex contractu regime may be asserted against the portal. The fact that YouTube is of foreign origin does not preclude suing YouTube in a Polish court. According to the CJEU's case-law, a user's dispute with YouTube will generally have a connection not only with Ireland, i.e. with the court of the State where Google Ireland Limited has its seat, but also with the courts of the place where YouTube provides its service. This will usually be the place where the YouTube user effectively operates.
