Abstract

The Act on Counteracting Abuse of Contractual Advantage in Trade in Agricultural and Food Products, which has replaced the previously binding act with the same title, has become effective as of 23 December 2021. In addition to introducing a number of changes arising from implementating the provisions of Directive 2019/633, the Polish legislator decided to supplement the so-called advantage regulation with several procedural aspects concerning, among other things, interim decisions and the procedure of voluntary submission to penalty. The aim of this article is to do a cross-sectional analysis of the new regulation, with particular emphasis on changes concerning the proceedings before the President of Office for Competition and Consumer Protection.
