Abstract

The article critically comments the thesis laid down in the Supreme Court judgment of 24 February 2016, I CSK 269/15, according to which a necessary element of the declaration of will to withdraw from an agreement would be the indication of circumstances underlying the reason for withdrawal. There are stronger argument in favour of adopting an opposite position, also in the case of a concurrence of legal grounds for withdrawal.
