Abstract

The article analyses whether automated content moderation carried out under the Digital Services Act may be recognized as fully automated decision-making within the meaning of Art. 22 of the GDPR. The article discusses the definition of content moderation and identifies the provisions of the Digital Services Act concerning automated content moderation. The concept of fully automated decisions within the meaning of Art. 22 of the GDPR is also explained. The article identifies the conditions under which moderation decisions are to be recognised as automated decisions within the meaning of the GDPR. The analysis also addresses a possible legal basis for fully automated moderation decisions.
