Abstract

The publication analyses the current judgements of the Supreme Court and the Supreme Administrative Court regarding correction of decisions issues by the Social Security Company. Unlike in a typical administrative proceedings, the solutions that ensure judicial control of decisions issued by the Social Security Company in social security cases cause discrepancies in the case law. The presented judgments of the Supreme Administrative Courts actually indicates that control performed by common courts ceases to be exclusive.
