The relationship between the Artificial Intelligence Act and the General Data Protection Regulation

Autor jest adwokatem i liderem specjalizacji Ochrona Danych Osobowych w Lubasz i Wspólnicy – Kancelarii Radców Prawnych sp. k. Absolwent studiów podyplomowych „Wykonywanie funkcji inspektora ochrony danych” w Instytucie Nauk Prawnych Polskiej Akademii Nauk. Autor kilkudziesięciu publikacji z zakresu ochrony danych osobowych.
Abstract
The relationship between the basic legal acts governing artificial intelligence and personal data is complex and generates a number of doubts of an interpretative and systemic nature. At the same time, the results of the legislative work on the AIA to date have revealed that the controversies are not limited only to the heterogeneous conceptual grid or erroneous references to the GDPR, but in order to uphold coherence of the legal system involve also the need for a broader view at the use of AI mechanisms in the process of personal data processing. The article attempts to synthetically analyse the provisions on artificial intelligence in the context of personal data protection regulations. The observations made are of a systemic nature and also refer to the specific solutions adopted in the AIA.
