Abstract

It is commonly acknowledged that the creditor are not harmed within the meaning of Art. 527 § 1 and § 2 of the Civil Code by the debtor's selling immovable property to a third party, if – due to the mortgages on that property – the creditor would not even partly satisfy his claim anyway. The aim of this article is to try find and answer whether this view should be reinterpreted in the case of a joint mortgage.
