Abstract

Civil proceedings are generally intended to settle civil issues, whereas criminal proceedings resolve criminal issues. Sometimes, there is a relationship between a criminal and a civil case whereby the same deed is an offence and produces legal consequences in civil matters. Therefore, civil proceedings exert an influence on criminal proceedings and vice versa. One of the manifestations of this interaction is the binding force of final criminal verdicts in civil proceedings. According to Art. 11 of the Code of Civil Procedure, the findings of a final verdict finding the defendant guilty of an offence issued in criminal proceedings are binding for the court in civil proceedings in the course of which the person who was not accused may invoke all circumstances which exclude or restrict their civil liability.
