Insurer’s liability covering damage arising “in connection with the possession of an agricultural holding”

Abstract
The Supreme Court judgement of 14 July 2017, II CSK 806/16 was issued in a case for payment of compensation against the insurer under third party liability insurance for farmers. In the opinion of the author of this commentary, it was correctly found therein that the insurer’s liability covering damage arising “in connection with the possession of an agricultural holding” does not depend on the occurrence of an event causing damage (injury) only within the spatial boundaries of the agricultural holding covered by third party liability insurance, since the decisive factor is the functional linking of such event to the possession of an agricultural holding (Art. 50.1 of the Act of 22 May 2003 on compulsory insurance, Insurance Guarantee Fund and Polish Bureau of Motor Insurers).
