The image of public officers in Web 2.0 times – civil law and personal data protection aspects

Abstract

The article discusses the issue of recording and disseminating the image of public officers on the internet. The problem in this area is perceived as relating to the situations whereby public officers are recorded by citizens while executing their service duties and then such recordings are placed on YouTube. There are no specific legal solutions regulating the matter comprehensively. On the other hand, the ban on disseminating an image without consent may be derived from Art. 23 of the Polish Civil Code and Art. 81 of the Act on Copyright and Related Rights. Restrictions with respect to recording and disseminating an image may also arise from personal data protection regulations. The article outlines legal solutions relating to these issues.
