Abstract

Conflict with a penal legal act as a cause of invalidity of a legal transaction

The article is devoted to the cause of a legal transaction’s invalidity described in Art. 58 § 1 of the Civil Code as “conflict with a legal act”. The abovementioned cause of a legal transaction’s invalidity is analyzed in the context of penal provisions. The author deliberates whether commitment of an offence when concluding a legal transaction may render such transaction invalid. Basic theoretical issues relating to the concept of using the construction of a legal norm in the penal law context have been also considered.
