Abstract
The article analyses the relations between the right to public information (the right of access to official documents) and the right to protection of personal data in light of the GDPR, in particular its Art, 86. In order to determine these relations, it is first established that sharing of personal data in official documents (i.e. within access to public information) is subject to the provisions of the GDPR as a specific processing situation referred to in Chapter IX, Art. 86 of the GDPR. Basing on the analysis of the EU and Polish laws, it is concluded that the Polish Act on access to public information does not fulfil the requirements of Art. 86, Art. 6.2 and 6.3 of the GDPR, as well as does not restrict the scope of application of the GDPR in that regard. Consequently, all of the basic principles of personal data protection (Art. 5-10 of the GDPR) and the rights of data subjects (Art. 12–22 of the GDPR) apply to personal data processing within the framework of access to public information.
