Abstract
The commentary analyses the Supreme Court judgement of 4th April 2019 (ref. no. III CSK 159/17). The author discusses the judgement criticising the lack of distinction between the indexation clause sensu stricto and the exchange rate clause. The author also holds the view that the thesis of inability to apply the provision of Art. 385 § 2 of the Civil Code was wrong, and that the judgement is disproportionate.
