Legal definition of a cartel based on Directive 2014/104/EU and the Act of 21 April 2017 on claims for redressing damage caused by infringement of competition law

Abstract

The Act of 21 April 2017 on claims for redressing damage caused by infringement of competition law, which is linked to transposition of Directive 2014/104/EU of the European Parliament and of the Council of 26 November 2014 on certain rules governing actions for damages under national law for infringements of the competition law provisions of the Member States and of the European Union relevance, came into force on 27 June 2017. In that Act, the legislator introduces a legal definition of a cartel. According to the definition it is an agreement or concerted practice between two or more competitors aimed at coordinating their competitive behaviour on the market or influencing relevant parameters of competition.
