Abstract

The Commission Regulation (EU) No. 1299/2014 on the technical specifications for interoperability relating to the ‘infrastructure’ subsystem of the rail system in the European Union introduces in its Article 7 so-called transitional periods in the application of Technical Specifications for Interoperability in relation to the subsystems as well as interoperability constituents. In the course of public procurement procedures carried out recently by the railway infrastructure managers as to the supply of interoperability constituents some doubts arose as regards the duration and scope of the exemptions from the application of TSI resulting from the transitional periods specified in Article 7. The present study is an attempt to resolve these doubts.
