Judicial control of individual administrative acts issued by the National Centre for Research and Development (NCBiR) and the National Science Centre (NCN)

Abstract

The NCBiR and the NCN were established as executive agencies, which is one of the forms of public juridical persons. One of the competences of the those agencies is to take sovereign, specific and individual administrative decisions.

Administrative acts of NCBiR and NCN are subject to judicial review with respect to public information, evaluation of applications for EU funding (only NCBiR) and allocating grants for projects (NCBiR) and research (NCN). With respect to public information, court judgements concerned eligibility of applications and the grant agreements, the timespan for protection of experts’ data, documentation of tasks financed by an executive agency. With regard to evaluation of applications for EU funding courts analyzed the scope and rules for re-assessment of projects and expert evaluation. As regards decisions of the Board of Appeal of NCN and NCBiR Councils court judgements concerned application of the Code of Administrative Procedure.
