The scope of application of the new consumer law

Abstract

When adopting Directive 2011/83/EU on consumer rights the European legislator aimed at, among other things, „putting in order” the legal situation relating to protection of consumer rights in Member States of the European Union. This text is meant to answer the question whether after the implementation of the provisions of Directive 2011/83/EU to national legal systems of individual EU Member States we shall be dealing with a uniform consumer protection law. The author focused on analysing the degree of harmonization of Member States’ laws and the objective scope of Directive 2011/83/EU. The discussion outlined in the article leads to the conclusion that it is still premature to talk about a uniform European consumer law.
