Concepts of regulation of civil law entities in the Civil Code and the Commercial Companies Code

Józef Frąckowiak
Abstract

The article synthetically presents the development of views concerning the understanding of the addressees of private law regulations. The author assumes that legal relationship is a rule of the applicable law. Other concepts, such as: civil law events, subjective rights, and legal entities are built around this central concept of civil law. Apart from legal entity as a notion directly related to legal relationship, private law also uses the concept of a person to designate its addressees. A person is anyone with legal capacity, that is in principle may be the subject of any private law relationship. Persons are divided into individuals (people), and organizational units. Organizational units, in turn, are divided into: legal persons, statutory persons, and organizational units without personality, which have only partial ability to be subject only to certain legal relationships.
