Abstract
This gloss presents the issue of the point in time as of which the time period for annulment of the security for a financial claim is counted. This issue is of special interest which it concerns a security established on one of the most important assets of the debtor, namely real property. In this gloss the author analyses the issues concerning not so much the time period itself or its duration, but in particular discusses the issues relating to the point in time as of which the time period for annulment of the security for a financial claim is to be counted. Moreover, the author analyses many important ancillary issues which are closely related to the subject and the thesis put forward by the Supreme Court in its commented resolution, and in particular the problems linked with the finality of a decision.
