Abstract
Tis article discusses the reasons for refusal to pass the benefit under the seized claim to the enforcement authority. The basis for refusal is similar in both judicial and administrative enforcements. This stems from the fact that enforcement concerns the same legal right – the claim. Both administrative and judicial enforcement regulations require the debtor of the seized claim to point out the reasons for refusal to pay the seized claim. The study attempts to systematize the reasons for debtor’s refusal to pay to the enforcement authority the benefit which under the seized claim is due to the debtor – both under judicial and administrative enforcements.
