Abstract
It is worthy of note that during any electoral campaign great care should be exercised in order to ensure electoral fairness and outcome that accurately reflects society’s choices. For this reason, Art. 111 of the Election Code of 5 January 2011 sets forth protections for personal interests of candidates. These cover any potential dissemination of untrue information that might distort the public opinion of a candidate and influence voters’ choices. This article intends to highlight pitfalls in the wording of this provision as well as its shortcomings which lead to uncertainty in the event of court proceedings.
