Abstract

The article concerns the Civil Code provisions, amended in 2014, relating to seller’s statutory warranty for defects. The authors analyse the new regulations of the statutory liability under a sales contract, which on the basis of reference from Art. 656 and 638 § 1 of the Civil Code are applicable to contracts for performance of a specific task and construction works contracts. The authors pointed out the interpretational doubts as regards liability for damages under the statutory warranty systems, the scope of warranty entitlements, warranty deadlines as well as its execution under construction works contracts, or the system of general contractorship and subcontractorship.
