Abstract
The text contains a report on the 5th Polish-German Forum for Law and Economy which was held on 5 November 2014 at the Securities Exchange in Warsaw. The Forum focused on comparing development directions of compliance in Poland and in Germany. The participants discussed current challenges of implementation of compliance management systems (CMS) from the viewpoint of a manufacturing undertaking, a pharmaceutical company and a global corporation, as well as the problems of implementation of compliance in subsidiaries. The forum discussed latest development in legal compliance, such as legal advantages of CMS, use of video surveillance system, personal liability of persons performing compliance function in companies and protection of employee personal data. Apart from that, also compliance in medium-sized companies was discussed. Advantages of the compliance function for small and medium enterprises were indicated. Methods for CMS support with IT solutions were presented, and due diligence and partner-screening issues were discussed. The Forum offered an opportunity for learning current challenges for compliance and a platform for an exchange of views by practicians from both countries.
