Abstract

An answer to the question whether farmers are entrepreneurs, that is whether they meet the substantive prerequisite of a commercial case, should be sought in the area of private law. The prerequisites of economic activity have been explicitly specified in literature and in judicature, and activity in the area of agriculture may also have characteristics of such activity, a consequence of which is that disputes pertaining thereto are considered by commercial courts (departments).
