Abstract

The article discusses the issue of absence of the defendant at a hearing as provided for in the amended Code of Penal Procedure. The position of the defendant in the proceedings before the court of first instance and in the course of appeal proceedings has been presented. The author also refers to problems which may arise from the obligation to deliver the sentence to the defendant who was absent when the sentence was pronounced. The article outlines the advantages and disadvantages of the new solutions.
