Abstract

The author raised the issue of interpretation of Art. 773¹ of the Code of Civil Procedure relating to resolution of the overlap of several judicial enforcements. Doubts arose in this respect after the amendment of Art. 773 of the Code of Civil Procedure of 16 September 2011 concerning resolution of the overlap of judicial and administrative enforcement. The author declared himself against the enforcement practice whereby when judicial enforcements overlap further enforcement is taken over by the competent bailiff but only as to a concrete method in all overlapping cases, while enforcement from debtor’s assets not covered by the overlap is continued by the existing bailiff.
